Terms of service

These terms are between you and Mailer123. By connecting a Google account or installing the add-on you accept them. If you do not, do not use the service.

The service sends personalised email from your own Google account, using a draft you write and a list you provide, and reports on delivery and engagement. We are not the sender of record — you are. Mail goes out under your address and your Google account's sending reputation.

You must not use the service to:

• send unsolicited bulk email, or mail anyone who has not agreed to hear from you;
• mail a list you bought, scraped, rented, or otherwise did not build;
• send after someone has unsubscribed, or remove or disable the unsubscribe mechanism;
• misrepresent who the message is from, or use a misleading subject line;
• send anything unlawful, deceptive, or that infringes someone else's rights;
• attempt to evade the sending limits, or operate multiple accounts to do so.

You must comply with applicable email law where you and your recipients are — including the CAN-SPAM Act, GDPR and PECR, and Canada's CASL — and with Google's bulk sender guidelines.

We may suspend or terminate an account that breaches this section, without notice and without refund. High bounce or complaint rates are grounds for suspension on their own.

Your plan sets a daily allowance. Google separately limits how much any single account may send — 500 messages a day from a personal Gmail address, 2,000 from a Google Workspace account — and we cannot raise those. Whichever limit is lower applies. A campaign that exceeds it pauses and continues the following day.

Paid plans are billed in advance through our payment processor and renew automatically until cancelled. Cancelling stops the next renewal; it does not refund the current period. We may change prices with 30 days' notice.

What the service can see, what it keeps and how to delete it is set out in the privacy policy, which forms part of these terms. In short: your list stays in your spreadsheet, and we hold campaign totals, engagement events keyed to row numbers, and your do-not-send list.

We aim to keep the service running but do not guarantee uninterrupted availability. Delivery itself depends on Google and on the receiving mail servers, neither of which we control.

The service is provided "as is". To the extent the law allows, our total liability is limited to the fees you paid in the twelve months before the claim, and we are not liable for indirect or consequential loss, including lost business or damage to sending reputation.

These terms are governed by the laws of India.
