Terms of Service

These Terms of Service ("Terms") govern your access to and use of mailer123 and its related services. By creating an account or sending email through the platform, you agree to these Terms.
1. Accounts and workspaces
You must be at least 18 years old and able to form a binding contract to use mailer123. Your data is organized into workspaces, and you are responsible for everything that happens in any workspace you own, including the activity of team members you invite.
You agree to provide accurate account information and to keep your login credentials and API keys confidential. Notify us promptly if you believe a key has been compromised.
2. Acceptable use and anti-spam
You may only send email to recipients who have given you permission to contact them. You must honor unsubscribe requests, include accurate sender information, and never send unsolicited bulk email, deceptive content, or anything unlawful.
mailer123 sends through shared infrastructure, so one sender's behavior affects everyone. We continuously monitor bounce and complaint rates and may automatically pause sending, suppress addresses, or suspend a workspace that puts deliverability or other customers at risk.
3. Your content and contacts
You retain ownership of the contacts, campaigns, templates, and other content you upload. You grant us the limited rights needed to host, process, and send that content to operate the service on your behalf.
You are the controller of the contact data you import and are responsible for having a lawful basis to process and email it.
4. Sending domains
To send from your own domain you must publish the SPF, DKIM, and DMARC records we generate and keep them in place. You are responsible for your domain's DNS configuration and for maintaining your own sender reputation.
5. Plans, limits, and billing
Each plan caps the number of sending domains and the emails you may send per day and per month, and sets how much analytics history you can view. These limits apply per account and are described on the pricing page.
Paid plans are billed in advance. You can upgrade, downgrade, or cancel at any time; changes take effect according to your current billing cycle. Sending pauses when you reach a plan limit and resumes on the next reset.
6. API, webhooks, and integrations
Our REST API, webhooks, and MCP server let you build on top of the service using per-workspace API keys. You are responsible for the security of your keys and for any usage they authorize, and you must stay within the published rate limits.
7. Suspension and termination
You may stop using the service and delete your account at any time. We may suspend or terminate access if you breach these Terms, abuse the sending infrastructure, or create risk for the platform or other customers.
8. Disclaimers and liability
The service is provided "as is" without warranties of any kind. We do not guarantee that every email will reach the inbox, as deliverability depends on factors outside our control, including your list quality and recipient mail providers.
To the maximum extent permitted by law, our liability for any claim relating to the service is limited to the amount you paid us in the prior twelve months.
9. Changes and contact
We may update these Terms from time to time. If we make material changes we will notify you, and continued use of the service constitutes acceptance of the updated Terms.
